15.04.2015 This is an application for modification of the order dated 09.01.2015 passed in Cr. Misc. No. 23472 of 2014. The Petitioner was allowed bail by order dated 09.01.2015 but on condition that an affidavit would be filed that he is not an accused in any other case.

It has been submitted while the main application was pending another case was instituted against him and, therefore, such an affidavit could not be brought to notice of this Court before passing of the order.

Considering the aforesaid, the order is modified to the extent that that condition No. II be ignored. The Modification Application stands allowed.

Let this order be communicated to Chief Judicial Magistrate, Kishanganj through FAX at the cost of the Petitioner in connection with Pothia P.S. Case No. 139 of 2012. Vikash/- (Anjana Prakash, J.) U T
