JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-04-2016 Heard learned counsels for the petitioner and the State. The petitioners being the nephews and daughter-in-law of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 337, 338, 308, 379, 504 and 427/34 of the Indian Penal Code. The prosecution case is that Bundel Ravidas being the elder brother of the informant used to assault his parents. On 27.11.2015 when the informant returned from his sister and asked his brother as to why he assaulted his father then all the accused persons started pelting stones. It is specifically alleged that petitioner no.5, Rahul Ravidas assaulted with brick on the head of the informant when mother of petitioner no.1, Awadhesh Ravidas and Savita Devi assaulted the wife of the informant.

Patna High Court Cr.Misc. No.15123 of 2016 (2) dt.12-04-2016 2/2 It is submitted by learned counsel for the petitioners that due to family dispute, the accusation has been levelled. The injury has been found to superficial simple in nature. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Nawada in connection with Warisaliganj P.S. Case No. 283 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
