The petitioner apprehends his arrest in a criminal prosecution registered under Sections 307, 326, 387/34 of the Indian Penal Code and under Section 27 of the Arms Act. Taking into consideration the fact that the petitioner is named in the first Information Report vide Annexure-1 as an accused, wherein there is specific allegation of his participation in the crime in question, and also taking into consideration the fact that the petitioner is accused in as many as five more criminal cases of serious nature, which is evident from paragraph 3 of the present bail application, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for anticipatory bail in connection with Begusarai Town P.S.Case 552 of 2015 pending in the court of the learned Chief Judicial Magistrate, Begusarai is rejected. However, if the petitioner surrenders in the court below within a period of four weeks from today and applies for regular bail, then the same shall be considered on its own merits

Patna High Court Cr.Misc. No.13493 of 2016 (2) dt.08-04-2016 2/2 without being prejudiced by the rejection of his prayer for grant of anticipatory bail by the present order.
