JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 25-03-2015 The present application has been for modification of order dated 01.10.2012 passed in Cr. Misc. No. 27078 of 2012 to the extent of permitting petitioner no. 2 (present petitioner) to leave India to go to Australia for the period of six weeks. Though, the petitioner has to leave India today i.e. 25.03.2015 but it is submitted that in the changed circumstances since the mater was not taken up, the petitioner will shift the date of travel since the sons of the petitioner are residing in Australia where the petitioner has to attend a family function. The petitioner was granted bail vide order dated 01.10.2012 passed in Cr. Misc. No. 27078 of 2012 in connection with GRPS Bakhtiyarpur P.S. Case No. 76 of 2010. On the grounds mentioned in the
Patna High Court Cr.Misc. No.12798 of 2015 (02) dt.25-03-2015 2/2 modification application, the prayer is allowed. Let the learned court below permit the petitioner to go Australia for six weeks from the date of receipt/production of a copy of this order on submission of Xerox copy of the passport with an undertaking with specific date on which the petitioner will return back and submit the travel documents passport with immigration stamp.
Accordingly, this modification application is disposed of.
