The petitioner is languishing in custody since 14.3.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is that the petitioner and co-accused Sanjay Mandal were apprehended and from their possession, 27 litres Nepali liquor were recovered.

It is submitted by learned counsel for the petitioner that the seizure list does not depict as from whose possession, what quantity of illicit liquor has been recovered. Learned APP submits that the petitioner was apprehended with the illicit liquor.

Considering the nature of recovery and the period

Patna High Court CR. MISC. No.34807 of 2019(2) dt.29-05-2019 2/2 under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge -II-cum-Special Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C 2 121 of 2019.
