JUSTICE PRABHAT KUMAR JHA ORAL ORDER 01-05-2015 Learned counsel for the petitioners seeks permission to delete Para 18 of the bail petition as it is stated therein that the petitioner is in jail custody since 07.12.2014 whereas the present petition is for anticipatory bail.
Prayer is allowed. Learned counsel for the petitioners is permitted to make necessary correction.
Heard both sides.
The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code and Sections 3(1)(X) of the SC/ST (POA) Act.
Patna High Court Cr.Misc. No.16518 of 2015 (2) dt.01-05-2015 2/3 The informant named the petitioners and alleged that all the accused persons abused the informant and took out Rs. 20,500/- from his pocket and they were demanding extortion for allowing him to do construction work. It is submitted that there is a case and counter-case. From the side of the petitioners, Jagdambi Singh had earlier filed Complaint Case No. 1072C of 2013 against the informant and others.
Having considered the fact that there is no allegation of assault against the petitioner nos. 1 and 2, namely, Sanjay Singh and Ranjay Singh @ Ranjan Singh, the above named petitioner nos. 1 and 2, in the event of their arrest or surrender in the court below within four weeks from today, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri U.K. Pandey, Judicial Magistrate, 1st Class, Jamui in Khaira P.S. Case No. 257 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
So far as the case of the petitioner no. 3 Indradeo Singh is concerned, he is alleged to have assaulted Sukesh Singh with iron rod on his neck and corresponding injuries are found; of course, the injuries are simple in nature, but having considered the facts aforesaid, I am not inclined to enlarge the above named
Patna High Court Cr.Misc. No.16518 of 2015 (2) dt.01-05-2015 3/3 petitioner no. 3 on anticipatory bail. Accordingly the same is rejected.
