1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 69 of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant with an allegation that petitioner established physical relation on false promise of marriage, it is submitted that relationship in between the petitioner and the informant was a consensual relationship between two consenting adults. It is also submitted that

No.37052 of 2026(3) dt.30-06-2026 2/3 informant was married to one Akash Kumar @ Akash Seth in the year 2017 but then was having issues with her husband, as such, she came in contact with the petitioner and even disclosed about her first marriage, but then the relationship which developed in between the petitioner and the informant had no promise of marriage nor marriage in between the petitioner and the informant could have taken place since the informant had not obtained divorce from Akash Kumar. It is next submitted that whenever a consensual relationship sours, a false case is instituted with an allegation that physical relation was established on false pretext of marriage. It is further submitted that in the FIR also, the informant has not disclosed about her first marriage with Akash Kumar which is still subsisting.
4. The Investigating Officer of the case, in compliance of the order dated 16.06.2026, is present in the Court.
5. On query of the Court from the Investigating Officer of the case that as to whether informant was married to Akash Kumar or not, on which she specifically replied that informant was married to Akash from before.
6. At this stage, the learned counsel appearing on behalf of the informant also does not dispute the said fact that

7. After hearing the learned counsel for the parties, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kankarbagh P.S. Case No. 194 of 2026 subject to the conditions as laid down under Section 482 (2) of BNSS.
8. Accordingly, the instant anticipatory bail application stands allowed.
9. The personal appearance of the Investigating Officer of the case is dispensed with.
