====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 09-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has filed the instant application for regular bail in connection with Maner P.S. Case no. 590/2019 registered under sections 302, 307, 147, 148, 149, 387, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act. As per the allegation in the first information report, twenty five named accused persons including the petitioner herein as also Bhushan Rai and Munna Rai are stated to have come variously armed. It is stated that Himanshu Rai, Shyamakant Rai, Jai Prakash Rai, Ravindra Rai and Ritik Kumar fired as a result of which two persons died in the occurrence.

It is submitted by learned counsel for the petitioner that no overt act has been alleged against this petitioner. He has

The case of the petitioner stands on a similar footing to that of Munna Rai, who has been enlarged on regular bail vide order dated 23.6.2020 passed in Cr. Misc. 18682 of 2020 and that of Bhushan Rai has been enlarged on bail vide order dated 24.8.2020 passed in Cr. Misc. No. 19517/2020. The petitioner is in custody since 15.5.2020 and chargesheet has been submitted in the case.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration that chargesheet has been submitted in the case and grant of bail to two co-accused, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Maner P.S. Case no. 590/2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur.
