Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 332, 341, 342, 504 of the I.P.C.
It is alleged that petitioner assaulted the informant being Headmaster of the school.
It is submitted by learned counsel for the petitioner that informant caused fracture injury on the hands of the petitioner's son and when protest was made then the present case has been lodged. Moreover for the occurrence of 01.09.2014 the First Information Report was lodged on 03.09.2014 and it reached to the learned Court below on 06.09.2014 which reflects that the First Information Report was registered with antedating.
Patna High Court Cr.Misc. No.7218 of 2015 (2) dt.03-03-2015 2/2 A supplementary affidavit has been filed to the effect that informant has not received any injury. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P.S. Case No. 131 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
