Petitioner happens to be husband of the complainant's daughter. Admittedly, marriage of the petitioner was solemnized with the complainant's daughter six years back and one child was born out of the aforesaid wedlock. Allegedly, petitioner and his other family members got disappeared the victim.

The contention on behalf of the petitioner is that present case was filed on 11.4.2012 and much prior to filing of the aforesaid complaint case, petitioner filed complaint case bearing Complaint Case No. 648C/2011 against the present complainant as well as her other family members making allegation that the present complainant as well as her other family members came at the house of the petitioner and took the victim with them and since then victim is missing.

Patna High Court Cr.Misc. No.6238 of 2015 (2) dt.16-02-2015 Learned counsel appearing for the petitioner submits that, as a matter of fact, victim had already solemnized her second marriage with another person and Panches of Gramkutchery, Hathiya block Jhajha district Jamui enquired into the matter and gave their decision on 5.4.2012 which is evident from annexure 3 to this petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Jamui in Complaint Case No. 480C/2012 subject to condition as laid down under section 438(2) of the Cr.P.C.
