The Petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 147, 148, 149, 307 of the I.P.C and Section 27 of the Arms Act.
The accusation of firing is against the petitioner and one Radha Paswan causing injury to a female labour.
It is submitted by learned counsel for the petitioner that though earlier the anticipatory bail application of the petitioner was dismissed vide order dated 15.07.2003 passed in Cr. Misc. No. 13960 of 2003 but petitioner was not sent up for trial and differing with the final form, cognizance has been taken in 2013. Though other co-accused has been
Patna High Court Cr.Misc. No.7799 of 2015 (2) dt.03-03-2015 2/2 granted bail by learned Sessions Judge.
Considering the fact that earlier anticipatory bail application of the petitioner was rejected by a co-ordinate Bench, this Court is not inclined to interfere. However, let learned Court below consider the prayer for regular bail of the petitioner, keeping in view of the fact that other co-accused has been granted bail by learned Sessions Judge, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection Bhagwanpur P.S. Case No. 88 of 2002, pending in the Court of learned Sub-Divisional Judicial Magistrate, Kaimur at Bhabua.
Accordingly the application is disposed off.
