JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-02-2018 Learned counsel for the petitioner submits that in this case even though non-bailable warrant of arrest and thereafter processes under Sections 82 and 83 Cr.P.C. have been issued against the petitioner, but prior to that the bail bond of the petitioner was never cancelled. Learned counsel further submits that the petitioner in this case could not appear before the trial court due to absence of information with regard to this case pending in the concerned court or with regard to the date which
Patna High Court Cr. WJC No.611 of 2017 (2) dt.16-02-2018 was fixed time to time. However, he submits that the petitioner is willing to surrender in the court below and explain the circumstances under which she could not appear in course of trial. Learned counsel for the State is present.
If the petitioner surrenders in the court below/trial court within a period of three weeks from today with an appropriate application, then the trial court shall consider the same in terms of the circumstances appearing from the records of the trial court as well as in accordance with law. The application stands disposed of.
