The petitioner seeks bail in connection with Bihar P.S. Case No. 863 of 2022 registered for the offence under Sections 399/402/414/420 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.

As per the prosecution case, one vehicle was caught by the police and six persons were found traveling in the vehicle and one country made pistol and some cartridges were recovered from the vehicle.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 12.11.2022. The other cases which have been mentioned in the present petition are also there because the petitioner was caught in the present case.

Patna High Court CR. MISC. No.38163 of 2023(2) dt.21-07-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda in connection with Bihar P.S. Case No. 863 of 2022.

The petitioner will visit concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
