JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 363, 366, 54, and 34 of the IPC.
As per FIR, this petitioner along with other accused persons abducted and assaulted the daughter of the informant. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the daughter of the informant in her statement recorded under Section 164 of Cr.P.C has stated that out of her own sweet will she married the co-accused, Sunil Kumar, and out of which one child was born. Petitioner has got no criminal antecedent.
Considering the statement of the victim recorded
Patna High Court CR. MISC. No.38657 of 2022(2) dt.22-11-2022 2/2 under Section 164 of Cr.P.C., in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VI, Sitamarhi in connection with Riga P.S. Case No. 52 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
