The petitioner is languishing in custody since 28.03.2019 in a case registered for the offences punishable under Section 290 of the I.P.C. and Section 37(c) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that the petitioner was creating nuisance after consuming liquor.

It is submitted by learned counsel for the petitioner that the petitioner has maliciously been framed in the present case and he has not been put on breath analyzer test. It is further submitted that though the petitioner is accused in one other case of similar nature, but he has been granted bail in that case.
