JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken under Sections 406,420,504,379 and 323 of the Indian Penal Code.

The prosecution case is that the petitioners entered into a compromise with the complainant that they will relinquish their claim in the property in question and in lieu thereof they received Rs.1,50,000/ each and both the parties will withdraw the cases filed against each other. Consequently, the complainant withdrew the two cases lodged on his behalf but the petitioners failed to honour the terms of agreement. When the complainant went to

Patna High Court Cr.Misc. No.12798 of 2016 (2) dt.28-03-2016 2/2 make protest then he was abused and assaulted. The anticipatory bail application of the petitioners was disposed of since the summons were issued. Statement has been made in paragraph 11 of the petition that only bailable warrants have been issued against them on 20.2.2016.

In the circumstances, let the learned court below consider the prayer for regular bail of the petitioners keeping in view the nature of accusation in case they surrender within six weeks from today in connection with Complaint Case No. 529 of 2015 pending in the court of learned A.C.J.M. Patnacity, Patna. The bail application of the petitioners may be disposed of by the learned court below, if possible, on the same day. This application is disposed of with the aforesaid observation/direction.
