For an occurrence alleged to have been committed on 18.05.2014 by the petitioner along with Wakil Sahni and Chin Lal Sahni wherein informant Rajdeo Sahni was assaulted by gun as well as lathi and further, during midst thereof, also took away one box containing cash as well as cloth, Written report was filed. From the injury report as is evident from para-21 of the case diary a grievous injury caused by hard and blunt substance has been found coming within the purview of Section 325, a bailable one which should also viewed in the background of omnibus allegation.

Accordingly, petitioner is directed to surrender before the learned lower court with a prayer for bail which the learned lower court will consider favourably in light of finding so recorded herein above.

Patna High Court Cr.Misc. No.9380 of 2015 (4) dt.04-05-2015 With the aforesaid observation, instant petition is disposed of.
