The petitioners are in custody in connection with Barauni (Zero mile) P.S. Case No. 179 of 2019, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. He further submits that in the instant case total 10.5 liters foreign liquor was recovered. He further submits that nothing has been recovered from the conscious physical possession of the petitioners. Learned counsel for the petitioners submits that petitioners are in custody

Patna High Court CR. MISC. No.35509 of 2019(2) dt.30-05-2019 2/2 in this case since 27.04.2019.

Considering the fact that petitioners have no criminal antecedent and they have remained in custody for more than 1 months, the Court is inclined to release the petitioners on bail. Let the petitioners named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned 2nd Additional Sessions Judge-cum Special Judge, Excise, Act Begusarai in connection with Barauni (Zero mile) P.S. Case No. 179 of 2019.
