The petitioners seek bail in connection with Barachatti P. S. Case No.722 of 2020, instituted for the offences under Sections 304(B)/ 34 of the Indian Penal Code. The learned counsel for the petitioners submits that the petitioners are in custody since 01.03.2021, they are persons with clean antecedent and charge-sheet has been submitted. The informant in the F.I.R. alleges that his daughter Khushbu Devi was married with Santosh Das in the Year 2020, but her husband and his family members were demanding Rs.50,000/- and on non-fulfilment of the same, the victim was tortured. Later, she was blessed with a female child, but in the

Patna High Court CR. MISC. No.47613 of 2021(2) dt.17-01-2022 2/2 night of 26.01.2020, it is alleged that the victim was killed by pouring kerosene oil and thereafter setting her at fire. The learned counsel for the petitioners submits that petitioners are not named in the F.I.R. nor in the re-statement of the informant made before the police and they are brother-inlaws of the deceased. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody since 01.03.2021, they are persons with clean antecedent, charge-sheet has been submitted and petitioners are not named in the F.I.R. and they are brother-in-laws of the deceased, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya in connection with Barachatti P. S. Case No.722 of 2020. The application stands allowed.
