2. This application for anticipatory bail arises out of Dhankund P.S. Case No. 67 of 2025, registered for the offence punishable under Section 191(2), 126(2), 115(2), 74, 118(1), 109(1), 303(2), 352, 351(2) of the Bhartiya Nyaya Sanhita.

3. As per allegation, during the intervening assault by several accused persons, petitioner is alleged to have assaulted the informant by means of iron rod on head, when the informant tried to save her daughter from assault by the coaccused persons.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.48949 of 2026(2) dt.22-07-2026 2/2 that the petitioner is innocent and has been falsely implicated in this case. It has further been submitted that the injury sustained by the informant is simple in nature. It has further been submitted that there is a case and counter case between the parties. It has lastly been submitted that the petitioner has got no criminal antecedents.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioner.

6. Heard the parties and perused the record.

7. Considering the facts and circumstances, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IIIrd, Banka, in connection with Dhankund P.S. Case No. 67 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.

8. This application is accordingly allowed.
