The petitioners, namely, Nirmala Devi and Bibha Devi, apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code.
The informant named six persons and alleged that Nirmala Devi, the petitioner no. 1, dragged her from a tube-well to her house and her husband Mahesh Yadav assaulted her with axe on her head. Bibha Devi, the petitioner no. 2, is alleged to have assaulted her with Khanti which hit on her right hand. Nirmala Devi is further alleged to have assaulted the son of the informant with axe on his head. It is submitted that Ajit Kumar Yadav, son of the informant, received head injury and the informant Veena Devi got two lacerated wounds by hard and blunt object. Although the injuries are simple in nature. Nirmala Devi, the petitioner no.
Patna High Court Cr.Misc. No.14257 of 2015 (2) dt.08-05-2015 2/2 1, lodged a case bearing Baheri P.S. Case No. 353 of 2013 against the informant and others and, on account of some petty dispute, the occurrence took place. The petitioners are ladies. Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender in the court below within four weeks from today, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Baheri P.S. Case No. 358 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
