Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 72/21, U/s41, 323, 365, 367, 376/34 of the IPC, Sections 3,4,5,6,7 Immoral Traffic Act and Section 4/6 of the POCSO Act.
As per FIR, one Suraj Kumar kidnapped the informant and forcefully engaged her in immoral act and forced her to join at Hotel Utsav Ground. Petitioner is the manager of the hotel in question.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. So far as this petitioner is concerned, he has only been implicated more because he happens to be the
Patna High Court CR. MISC. No.38656 of 2022(2) dt.22-11-2022 2/2 manager of Hotel Utsav. Petitioner has got no criminal antecedent.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Session-cumSpecial Judge (POCSO) in connection with Special (POCSO) Case No. 72/21 (Arising out of K.Hat Sahayak) P.S. Case No. 476 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
