The petitioners are languishing in custody for the offences punishable under Sections 272/273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From a four-wheeler 113 liters of foreign liquor was recovered.

Submission is that neither the vehicle nor the liquor was of the petitioners. The petitioners were apprehended on suspicion that he was fleeing from that vehicle. The petitioner has stated on oath that they have got

Patna High Court CR. MISC. No.35770 of 2019(2) dt.03-06-2019 2/2 no criminal antecedent. They are in custody since 22.04.2019. Considering the entire facts, let the petitioners, above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Uchakagaon P.S. Case No.82 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
