====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 27-05-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Dhamdaha P.S.Case No. 64 of 2018 registered for offences punishable under Sections 341, 323, 376, 511 and 379/ 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the case of the petitioner stands on similar footing to that of four other co-accused persons, who have been granted bail by order dated 13.02.2019, passed in Cr. Misc. N. 8049 of 2019 by this Court and a copy of the order has been annexed as Annexure-2 in the instant application.

On going through the aforesaid order dated 13.02.2019, it transpires that four other co-accused have been

The learned A.P.P. does not dispute that the case of the petitioner stands on a similar footing to other four coaccused persons, who have already been granted bail. In view of the facts and circumstances of the case, let the petitioner, Md. Barik, in the event of his arrest or surrender in the Court below within a period of four weeks from today in connection with Dhamdaha P.S.Case No. 64 of 2018, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea, subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
