2. Basically, the grievance of the petitioner, who is the elected Pramukh of Sidhwalia Prakhand Panchayat Samiti in the district of Gopalganj is that the Block Development Officer-cumExecutive Officer, Panchayat Samiti, Sidhwalia is not giving due respect to the Panchayat Samiti and also not complying with the directions issued to him.

3. From the pleadings, it appears that the Principal Secretary, Panchayati Raj Department, Government of Bihar has directed the District Magistrate-cum-Collector, Gopalganj to do the needful in the matter.

4. Learned counsel for the parties agree that the writ petition be disposed off directing the District Magistrate-cumCollector, Gopalganj to act as the person who should sort out any differences which may arise between the Panchayat Samiti, including the petitioner, and the Block Development Officer with regard to proper functioning and implementation of the decisions of the Panchayat Samiti.

5. In view thereof, the writ petition stands disposed off with liberty to the petitioner to move before the respondent no. 3 as and when such occasion arises for any grievance which she or the Panchayat Samiti may have against the respondent no. 6 relating to

6. Learned counsel for the State as well as the respondent no. 7 have assured the Court that the Block Development Officer shall discharge his duties relating to proper functioning of the Panchayat Samiti without any slackness. The respondent no. 3, as and when required, shall intervene in the matter to sort out the differences between the parties so that ultimately the Panchayat Samiti runs in accordance with law and the decisions taken by it, in accordance with law, are also implemented without any undue delay.
