The petitioners seek bail in anticipation of their arrest in connection with Raxaul Rail P.S. Case No. 08 of 2020 dated 09.06.2020 instituted for the offences under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code.
Both the petitioners are alleged to have assaulted the informant by hard and blunt substance but there are no corresponding injuries on the person of the informant. In fact, the informant has received simple injuries which cannot be said to have been caused by the
Patna High Court CR. MISC. No.35131 of 2020(2) dt.22-03-2021 2/2 assault perpetrated by the petitioners. The petitioner no. 1 had earlier filed a case against the informant of this case vide Raxaul P.S. Case No. 170 of 2020.
Apart from this, it has been submitted that the story of giving loan to the petitioners does not appear to be correct as the parties are on inimical terms. Considering the aforestated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Magistrate, Bettiah, West Champaran in connection with Raxaul Rail P.S. Case No. 08 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
