JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324 and 504 of the Indian Penal Code and under Section 27 of the Arms Act.
In the background of the land dispute, it is alleged that the accused persons including the petitioner variously armed came and started to open the shop. On protest being made by the informant, coaccused Dharmendra Singh assaulted with Bhala causing injury on the cheek of the brother of the informant.
It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled against the petitioner. Maheshkhunt P. S. Case No. 81 of 2015 was lodged from petitioner side against the informant at earlier point of time. Statement has been made
Patna High Court Cr.Misc. No.12792 of 2016 (2) dt.28-03-2016 2/2 in paragraph-3 of the petition that the petitioner has got no criminal antecedent.
Considering the facts and circumstances, let the petitioner above named be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Maheshkhunt P.S. Case No. 82 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
