JUSTICE RAKESH KUMAR ORAL ORDER 09-11-2016 This is second attempt for grant of anticipatory bail. Earlier, prayer for anticipatory bail of this petitioner was rejected by a bench of this court long back on 18.7.2012 vide Cr. Misc. No. 19408 of 2012.

The petitioner is one of the F.I.R. named accused in Karpi P.S. Case No. 15 of 2011 corresponding to N. D. P. S. Case No. 5 of 2011 registered for the offence under Section 20 of the Narcotic Drugs And Psychotropic Substances Act. It appears that it was alleged that petitioner was cultivating Ganja plant and in his courtyard number of Ganja plants were found. Despite the fact that petitioner was named with specific accusation in the year

Patna High Court Cr.Misc. No.17042 of 2016 (3) dt.09-11-2016 2/2 2011 and his prayer for anticipatory bail was rejected by this Court in the year 2012 still the petitioner is at large and this is the reason that he has courageously filed second anticipatory bail petition which normally is not entertained. Prayer for anticipatory bail again stands rejected.

Let a copy of this order be sent to the concerned Superintendent of Police to examine as to under what circumstances in such serious matter the accused is still at large.
