1. Heard learned counsel for petitioner and learned Additional Public Prosecutor.

2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. This application is filed for grant of regular bail in connection with Jagdishpur P.S. Case No. 92 of 2023 registered under section 20(b)(ii)(c), NDPS Act.

4. Learned counsel for the petitioner submits that 11 kgs of Ganja has been recoverd from the possession of the petitioner.

5. Various ground have been agitated for grant of bain including the ground that similarly situated accused persons have been granted bail. The recovery from the other accused who have been granted bail is between 2kg

Patna High Court CR. MISC. No.37788 of 2023(2) dt.19-07-2023 2/2 to 6kg.

6. In view of the bar under Section 37 of the NDPS Act, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.

7. The Trial Court is directed to expedite the trial as early as possible.
