Heard the learned counsel for the petitioner and the learned counsel for the State.

Perused the impugned order dated 30.01.2017 passed by learned Sub Judge V, Ara in Title Suit No.250 of 2003 whereby the learned Court below has recalled the earlier order dated 01.12.2016 on the ground that the widow and two sons are already on record who are contesting the case filed by the State-plaintiff respondent. This application has been filed by the defendant No.2. The names of the daughters have been deleted.

Admittedly, name has already been deleted, they have got no grievance as they are not aggrieved by the impugned order. 4.

Thus, I find no reason to interfere with the impugned order at the instance of the defendant whose name has not been deleted. 5.
