Petitioner apprehends his arrest in connection with Mufassil P. S. case no. 308/2014 registered under section 366A/34 of the IPC. Admittedly, victim has returned to her home safely and her statement under section 164 Cr.P.C has been recorded. The victim has not disclosed name of the petitioner in her statement recorded under section 164 Cr.P.C and it appears from perusal of the first information report as well as the impugned order of learned Sessions Judge that only suspicion has been raised against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let
Patna High Court Cr.Misc. No.5631 of 2015 (2) dt.11-02-2015 the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Mufassil P. S. case no. 308/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
