27-03-2017 Learned Senior Counsel appearing on behalf of the petitioners has submitted that so far as petitioner Nos. 4 and 5 are concerned, the present application has become infructuous inasmuch as the Lav Kush Para Medical & Nursing Tranning Sansthan ( A.N.M.School), Faizalganj, Sasaram, has accepted their examination forms for IInd years examination of RANM.

The sole grievance with which the petitioners have approached this Court is that the said A.N.M. School is not accepting their application forms for the said examination. Learned Counsel appearing on behalf of the said A.N.M. School states, on instructions, that because the petitioners had not deposited their fees, their examination forms were not accepted. In response to the submission, learned Senior Counsel appearing on behalf of the petitioners has submitted that the petitioners undertake to clear all the dues of the College by tomorrow (28.03.2017). I do not think there is any lis to be adjudicated upon by this Court since the dispute is primarily between the petitioners and the private respondents, viz, A.N.M. School. Learned Counsel appearing on behalf of the Nursing Council of India has referred to a decision of this Court in case of Devendra Prasad Vs. B.R.A. Bihar University, Muzaffarpur reported in 2015(1) PLJR 815, raising an

objection over maintainability of the writ application. However, in view of the stands taken on behalf of the parties, as noted above, I have not gone into that question.

This application stands disposed of.
