2. The petitioner seeks regular bail in connection with S.T. No. 259/2023 (corresponding to Amarpur P.S. Case No. 573/2022, registered for the offence punishable under Sections 365, 302, 201 of the Indian Penal Code.

3. As per prosecution, the deceased who is the son of the informant got a phone call and he went out. Subsequently his dead body was found.

4. Learned counsel for the petitioner submitted that during investigation, no material has come to connect the petitioner with the alleged crime.

5. Learned APP submits that Md. Suphian has given self inculpatory statement and has confessed that this petitioner

6. The petitioner is in custody since 21.10.2022.

7. Considering the nature of allegation and period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Additional Sessions Judge-1, Banka in connection with S.T. No. 259 / 2023 (corresponding to Amarpur P.S. Case No. 573/2022).

9. The petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
