In this case, the petitioner is seeking regular bail in connection with Murliganj P.S. Case No. 4 of 2023, registered for the offences punishable under Sections 302, 120(B), 34 of the IPC and section 27 of the Arms Act.

As per FIR, the petitioner along with 22-23 coaccused persons came to the house of the informant and shot dead his father.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No occurrence is alleged to have taken place. He has submitted further that exactly on similar footing, co-accused Sunita Devi has been granted bail by the coordinate Bench of

Patna High Court CR. MISC. No.37690 of 2023(2) dt.03-07-2023 2/2 this Court in Cr. Misc. No. 35283 of 2023. The petitioner is under custody since 04.01.2023.

Considering the above-mentioned facts and circumstances especially the fact that the other co-accused on similar footing has been granted bail by the coordinate Bench of this Court, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Excise Court, Patna in connection with Murliganj P.S. Case No. 4 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
