The petitioners seek bail in connection with Rasulpur P.S. Case No. 15 of 2025 instituted for the offence under Sections 103(1) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case, in short, is that petitioners and co-accused assaulted informant's brother, resulting in his death. As per the FIR, petitioner No.1 assaulted the informant's brother with knife on his head and petitioner No.2 caught hold the brother of the informant and subsequently, petitioner No.2 has assaulted the brother of the informant.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 06-02-2025. Petitioners bear no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. Learned counsel for the petitioners submits that petitioner No.1 is student, whereas petitioner No.2 is labour and they have been implicated entirely on concocted allegation. Nothing has been recovered from the possession of the petitioners. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. There is direct allegation against the petitioners, which is corroborated by the postmortem report, wherein it is opined by the doctor that death is due to hemorrhage and shock due to blunt and sharp cut.

Considering the aforesaid facts and circumstances of the case and there being direct allegation against the petitioners, which is corroborated by the postmortem report, hence, this Court at this stage, is not inclined to grant bail to the

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.
