The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

It is alleged that on the order of coaccused Shankar Paswan, petitioner no. 1 put rope around the neck of the informant and started pulling it when the informant's sister-in-law(Bhabhi) came to save then she was assaulted by co-accused Shankar Paswan and his wife and Shankar Paswan snatched gold ear-ring resulted into cut injury to her ears and petitioner no. 2 snatched Rs. 11,500/- from the pocket of the informant.

It is submitted by learned counsel for the petitioners that the petitioners are co-villagers of

Patna High Court Cr.Misc. No.11844 of 2015 (2) dt.23-03-2015 2 / 2 the informant and due to petty dispute, accusation has been levelled. The injury report suggests superficial simple in nature. A statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Dumariaghat P.S. Case No. 44 of 2014 (G.R. Case No. 1754 of 2014) on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M.Ist Class, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
