Petitioners apprehend their arrest in Complaint Case No. 2310(C) of 2012, instituted under Sections 109, 323, 420, 406, 384/34 and 120(B) of the Indian Penal Code. It is alleged that the accused persons have induced the complainant for entering into business with them. The complainant paid a sum of Rs.5.00 lakhs to them, which he collected from his friends and relatives. He further submits
Patna High Court Cr.Misc. No.16909 of 2016 (2) dt.06-05-2016 2/2 that the accused persons did not do any business and thus, cheated him.
Learned counsel for the petitioners submits that in fact complainant has cheated them. Furthermore, instant case is by way of reaction to the earlier case lodged by one of them.
Having regard to the facts and circumstances of the case, in the event of arrest/surrender, let the petitioners named above, be released on bail on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria, in connection with Complaint Case No. 2310(C) of 2012.
