The petitioner is languishing in custody since 14-03-2019 in a case registered for the offences punishable under Sections 25(1-B) a, 26 and 35 of the Arms Act.

The prosecution case is that one country made pistol and 5 live cartridges were recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been framed in this case on the basis of suspicion. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that during search, loaded pistol and five live cartridges were recovered from the petitioner.

Ist Jhanjharpur, Madhubani in connection with Jhanjharpur P.S. Case No. 53 of 2019.
