In this application for anticipatory bail the petitioner apprehends her arrest for the offence punishable under sections 341, 447, 323, 324, 307, 504, 379 and 34 of the I.P.C. There is case and counter case. It is submitted that in this case Manoj Sahni, Ajay Sahni, Jyotik Sahni, Singhasan Sahni and Govind Sahni @ Govinda Sahni, all have been allowed prearrest bail by another Bench of this Court vide order dated 08.01.2014 in Cr. Misc. No. 37606 of 2013 as injury sustained by the informant was found simple in nature.
The learned A.P.P. is not in a position to distinguish the case of the petitioner from those co-accused.
Patna High Court Cr.Misc. No.30909 of 2014 (2) dt.27-01-2015 2/2 In the facts and circumstances as stated above, the petitioner who is a lady, in case of her arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Motihari, East Champaran in Harsidhi P.S. Case No. 174 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
