The petitioner seeks pre-arrest bail in connection with Complaint Case No. 669(C) of 2012 in which cognizance has been taken under Sections 406, 420, 120-B of the Indian Penal Code and Section 138 of the Negotiable Instruments Act, 1881. It has been contended by the learned counsel for the petitioner that the petitioner has maliciously been implicated in the present case. As a matter of fact, the petitioner and the complainant had friendly relation and somehow or the other he retained the cheque duly signed by the petitioner and subsequently presented the same for encashment.

No.12108 of 2016 (2) dt.17-03-2016 2/2 Be that as it may, regard being had to the nature of offence, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Complaint Case No. 669(C) of 2012, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
