Petitioner seeks regular bail in a case registered for the offence punishable under Section 307, 326 and some other allied Sections of the Indian Penal Code.
As per the prosecution case, this petitioner assaulted five times with sword upon the informant.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is case and counter case in which both sides sustained injuries. It is submitted that the doctor, who issued injury report, has stated that time, cause and nature of injury could not be ascertained because of surgical interference on the
Patna High Court CR. MISC. No.46739 of 2021(3) dt.07-01-2022 2/2 wound by a private doctor in a private nursing home. Petitioner claims clean antecedent and is in custody since 23.04.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Saran at Chapra in connection with Rivilganj PS case No.181/2020.
