Petitioner apprehends his arrest in connection with Kazi Mohammadpur P.S. Case No. 186 of 2012 registered for the offences punishable under Sections 147, 148, 149, 323, 307, 387, 504, 379 of the Indian Penal Code and Section 27of the Arms Act.

Allegedly, the petitioner opened fire with Nalkatua and assaulted with the butt on the head of the informant causing bleeding.

Submission is that there is case and counter case. Injury report vide annexure-3 goes to show that the informant has

Patna High Court Cr.Misc. No.30875 of 2014 (2) dt.27-01-2015 received simple injury lacerated wound on forehead 1"x1/4"x skin deep which is superficial in nature, and as such, the petitioner deserves sympathetic consideration to which the learned APP does not dispute.

In the facts and circumstances stated above, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No. 186 of 2012, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
