The petitioners apprehend their arrest in a case under section 307 and other sections of the Indian Penal Code. Manish Chourasia named the petitioners and alleged that while he was returning to his house along with his father, the petitioners along with others assaulted the informant, his brother Anil Kumar and father Krishna Chandra Chourasia and other family members.
It is submitted that the petitioners were working as labour in the ready-made shop of the informant. When the petitioners went to demand wages, the informant and others assaulted the petitioners for which Complaint Case No. 263(c) of 2014 was filed on 12-4-2014 and on 15-4-2014 it appears that the petitioners and the brother of Ashok Ravidas are alleged to have assaulted the informant and his father Krishna Chand Chourasia
Patna High Court Cr.Misc. No.33318 of 2014 (4) dt.06-04-2015 2 / 2 and they got simple injuries. There is a counter-version. Considering the aforesaid facts, it is directed that in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, petitioner no.1 Ashok Ravidas and petitioner no.3 Akash Ravidas shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai, in Lakhisarai P.S. Case No. 208 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
So far as the case of petitioner no.2 Subhash Ravidas for grant of anticipatory bail is concerned, he is alleged to have assaulted Anil Chourisia with iron rod on his head and Anil Chourisia got grievous injuries on his head.
Hence, I am not inclined to grant anticipatory bail to petitioner no.2, Subhash Ravidas. Hence, the anticipatory bail of Subhash Ravidas is rejected.
