JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Morhowrah P.S. Case No. 264 of 2014, registered under Sections 341, 323, 324, 307, 354 and 379/34 of the I.P.C. The contention on behalf of the petitioner is that the present case has been lodged in retaliation to the Complaint Case No. 2181 of 2014 which was filed by the father of petitioner on 21.07.2014 whereas the present case was lodged on 11.08.2014. There is specific accusation against the petitioner that he alongwith one other co-accused caught the informant's minor daughter with bad intention and when the informant and other family members made protest, they were assaulted by the petitioner and his associates.

No.12198 of 2015 (2) dt.31-03-2015 2 / 2 Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to grant privilege of anticipatory bail to the petitioner and accordingly, his prayer for grant of anticipatory bail in connection with Morhowrah P.S. Case No. 264 of 2014, pending in the court of the learned C.J.M., Saran at Chapra, stands rejected.
