JUSTICE RAKESH KUMAR ORAL ORDER 21-11-2016 Heard Sri Ram Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The petitioner , who is husband of the complainant/ opposite party no. 2, has approached this court for grant of anticipatory bail in Complaint Case No. 1391(C ) of 2014 in which learned Judicial Magistrate 2nd Class, Buxar after conducting enquiry has taken cognizance of offence under Section 498A of the Indian Penal Code. On perusal of the order of cognizance which has been brought on record it is evident that after cognizance the learned Magistrate has directed for issuance of summon for securing appearance. Instead of appearing it appears that petitioner filed petition for grant of anticipatory bail
Patna High Court Cr.Misc. No.15262 of 2016 (5) dt.21-11-2016 2/2 before the Sessions Court which has been rejected. In this case except the petitioner , who is husband, other family members have already been extended the privilege of anticipatory bail. In the complaint there is specific accusation against the petitioner. I do not find any ground to extend the privilege of anticipatory bail.
The petition stands dismissed.
In view of dismissal of this petition, interim order of stay stands automatically vacated.
