====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Forbesganj P.S. Case No. 706 of 2024 dated 26.11.2024 registered for the offence punishable under Section 309(4) of the B.N.S., 2023.

3. As per the prosecution case, the informant is posted in Bandhan Bank at Raniganj Branch on the post of R.O. It is further alleged that on 25.11.2024 at about 6.00 P.M., she alongwith her brother Aditya Anand were coming from Raniganj to Forbesganj by their Scooty at about 6.30 P.M., and when she reached near Dogachhi More, three persons riding on the Splender Motorcycle overtook and surrounded them and on

Patna High Court CR. MISC. No.35512 of 2025(3) dt.12-08-2025 2/3 the point of weapons, they snatched her Scooty bearing Registration No. BR38U5248, Mobile, Purse containing ATM Card, Pan Card and Aadhar Card which were kept in the dickey of the Scooty and fled away from there.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is not named in the F.I.R. and only on the basis of suspicion, police arrested him and took his confessional statement by taking his signature on a blank paper. The looted articles have not been recovered from the possession of the petitioner rather the looted scooty has been recovered from another place as stated in paragraph no. 47 of the case diary. The petitioner was not put on T.I. Parade. The petitioner has no concern with the alleged offence. The petitioner has one criminal antecedent in which he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 22.02.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond

Patna High Court CR. MISC. No.35512 of 2025(3) dt.12-08-2025 3/3 of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Araria in connection with Forbesganj P.S. Case No. 706 of 2024 with further condition:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
