JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-07-2022 Though the present writ petition has been filed for directing the respondents not to dispossess the petitioner and his family members from the land appertaining to Mauza Tiskhora, Thana No. 121, Khata No. 741, Khesra No. 1108, Block-cum-Anchal-Naubatpur, District-Patna, however, during the interregnum period, it appears that an encroachment case bearing Encroachment Case No. 7A/2018-19 has been initiated by the Circle Officer, Naubatpur, Patna.

Patna High Court CWJC No.3549 of 2018(3) dt.19-07-2022 2/2 At this juncture, the learned counsel for the petitioner seeks liberty to file appropriate show cause reply and till the final decision is taken by the Circle Officer, Naubatpur, Patna i.e. the respondent no. 5, he seeks some protection. Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with liberty to the petitioner to file his show cause reply before the respondent no. 5 within a period of four weeks from today, whereupon the respondent no. 5 shall pass final orders under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, within a period of eight weeks, thereafter.

It is needless to state that for a period of 12 weeks from today, status quo existing as on today, shall be maintained. The writ petition stands disposed off on the aforesaid terms.
