JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

It is alleged that the informant demanded `5,000/- from his uncle for getting her medically treated then the uncle of the informant conveyed that she has to execute the mortgage deed with regard to five dhurs of land in favour of Manjhi Mahto who will give her `5,000/- then the informant after going to Bhutahi Registry Office, executed the mortgage deed and received money. Subsequently, she came to know that she was mislead to execute a sale deed with regard to land of Mofida Khatoon. It is alleged against the petitioners that they were also present in the Registry

Patna High Court Cr.Misc. No.6496 of 2015 (2) dt.19-02-2015 2/2 Office when she executed the deed of mortgage. It is submitted by learned counsel for the petitioners that the petitioners are neither the beneficiary of the sale deed nor they are the witnesses to the same. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Bathnaha P.S. Case No. 276 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
