Petitioners seeks anticipatory bail in Sitamarhi P.S. Case No. 759 of 2015 registered under sections 272, 273, 147, 148, 149, 332, 333, 353, 435, 427, 337 and 504 of the Indian Penal Code and Section 47(A) of the Excise Act.
It is stated that recovery of illicit liquor is shown from the shop of Manoj Kumar @ Bhola Sah. On protest being made, the petitioners and others took the motorcycle of the Police and put it on fire.
Counsel for the petitioners submits that the allegation is general and omnibus. He has produced a copy of the order dated 11.01.2016 passed in Cr. Misc. 1255 of 2016 wherefrom it appears
Patna High Court Cr.Misc. No.13053 of 2016 (2) dt.22-04-2016 2/2 that one of the co-accused of this case moved this Court for bail in which an order has been passed directing him to surrender in the light of observations made therein.
In my view, the petitioners should also surrender and seek bail in the light of observations made in the case of co-accused Munna Kumar vide Cr. Misc. No. 1255 of 2016.
The application is disposed of.
