JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 143, 341, 323, 324, 504, 506 and 379 of the Indian Penal Code.

Prosecution case is that the petitioner assaulted the informant with farsa on his head, whereas, co-accused Uday Sharma tried to strangulate the informant and snatched a gold chain.

It is submitted by learned counsel for the petitioner that the two lacerated injuries have been found on the left and right temporal region on the informant but both the injuries were found to be simple in nature, caused by hard and blunt substance. There is a counter version of occurrence is also. Moreover, co-accused

Patna High Court Cr.Misc. No.12533 of 2016 (2) dt.17-03-2016 2/2 Uday Sharma, has been granted bail by the learned Court below itself.

A statement has been made in paragraph -3, that the petitioners have no criminal antecedent.

Considering the accusation not being corroborated by the medical opinion, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of twelve weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya in connection with Alipur P.S. Case No. 01 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) sunil/- U T
